Mental Capacity Act (MCA)
The Mental Capacity Act 2005 affects people who can’t make decisions for themselves, perhaps because of:
- learning disabilities
- mental health problems
- head injuries or strokes
- drug, alcohol or substance addition
- acute illness, or the treatment for it
All major decisions are covered by the Act, from how their finances are managed to whether or not they have medical treatment.

In conjunction with the MCA, Regulations and the statutory guidance in the MCA code of practice, our local guidance the ‘Implementation of the Mental Capacity Act 2005’ must be read.
Professionals Mental Capacity Act training
Training on the MCA is being made available to all service providers in Sheffield, including the independent sector.
We have online learning packages on our Sheffield Development Hub. If you are in Sheffield Teaching Hospitals, Sheffield Health and Social Care Trust and NHS Sheffield you will need to contact your training manager. If you are part of another organisation please email Geoff.firstname.lastname@example.org.
The Department of Health website has a number of training materials that are available to everyone.
Deprivation of Liberty Safeguards (DoLS)
The Deprivation of Liberty Safeguards aims to prevent the unlawful detention of adults in hospitals, and care settings, who lack capacity to choose where they live or to consent to care and treatment.

A DOLS application form should be completed if an Urgent authorisation is being issued by the Managing Authority and/or a request for a standard authorisation is being made.
It is essential that as much information as possible about the person and their circumstances is provided. All applications submitted via email must be done through a secure route, this is currently possible through the use of AnyComms.

Professionals Deprivation of Liberty Safeguards training
Free training on the DoLS is made available to all service providers in Sheffield, including the independent sector. We currently have three types of training available:
- Mental Capacity Act Workshop – These are 2 hour sessions designed for care and support workers to attend, providing a broad understanding of the act and it’s implications
- Managing Authority – These are 3 hour sessions designed for those who work in registered residential or nursing care
- Supported Housing and Carers Training – This is a full day ran by CQM Learning, providing awareness of the Act and its implications to people who work with adults who may lack capacity to make some decisions for themselves
