It is unlawful to remove human remains, including cremated remains, from a place of burial without first receiving permission from the relevant authority. Permission of the Home Office or Diocese must be obtained before an exhumation can proceed.
If it is decided to remove remains, for whatever reason, it must be established whether these are buried in consecrated or general ground. Generally, if buried in consecrated ground, application must be made to the Diocese and, if general ground, to the Home Office. If the ground is owned by us, approval must also be obtained from the Burial Authority (Bereavement Services).
In some cases, the permission of both the Home Office and Diocese may be required.
