Meeting held 23rd October, 2007

1. CHAIR OF MEETING
In the absence of the Chair (Councillor Chris Rosling-Josephs), the Deputy Chair (Councillor Peter Price) chaired the meeting.
2. APOLOGIES FOR ABSENCE FROM MEMBERS OF THE BOARD
Apologies for absence were received from Councillors Jackie Drayton, Robert MacDonald and Chris Rosling-Josephs and Councillors Martin Lawton, Garry Weatherall and Ian Saunders attended the meeting as the duly appointed substitutes, respectively.
3. DECLARATIONS OF INTEREST
Councillor Graham Oxley declared an interest as a Member of Ecclesfield Parish Council in relation to those applications that the Parish Council had considered, but indicated he would participate in their determination, if they were to be considered by this Board, as he had not pre-determined his views on applications during the meeting of the Parish Council.
4. MINUTES OF LAST MEETING
The minutes of the meeting of the Board held on 9th October, 2007, were approved as a correct record.
5. SHEFFIELD CONSERVATION ADVISORY GROUP
The Board noted the minutes of the meeting of the Sheffield Conservation Advisory Group held on 25th September, 2007.
6. SITE VISIT
RESOLVED: That a site visit for the morning of Tuesday, 13th November, 2007, in connection with any planning applications requiring a site visit by Members prior to the next meeting of the Board.
7. NEW PETITIONS
The Board (a) noted for investigation by officers and reporting back to a future meeting, the receipt of petitions (i) containing 177 signatures concerning noise pollution created by the move of Abbey Stainless Steels to Beeley Wood Works and (ii) containing 14 signatures requesting residents’ parking at Mill Lane, Deepcar and (b) heard representations from a representative of the petitioners in respect of the aforementioned petition concerning Beeley Wood Works, concerning the disturbance that the perceived increased noise levels created by industrial hammers was having on local residents and in respect of an extension that had been built at the works without planning permission. In response, the Director of Development Services referred to the contents of a letter which had been sent to the petition organiser explaining that Beeley Wood Works was a longstanding industrial use and that the Council had no power to prevent Abbey Stainless Steels moving to the site as there was no material change of use. With regard to the construction of an extension, it was indicated that an application for planning permission had been requested from the owners of the site and that the Environmental Protection Service was investigating issues of noise disturbance to residents.
RESOLVED: In the light of the comments now made, the Director of Environment and Regulatory Services be requested to attend the next meeting of the Board to report on noise levels emanating from the Beeley Wood Works site and that the Director of Development Services be requested to consider, in the event that industrial hammers were being used in the new extension, for a Stop Notice to be issued, until the required application for the building and its use had been determined.
8. APPLICATIONS UNDER VARIOUS ACTS/REGULATIONS
RESOLVED: That (a) the applications now submitted for permission to develop land under the Town and Country Planning Act 1990 and the Regulations made thereunder and for consent under the Town and Country Planning (Control of Advertisements) Regulations 1989 be decided, granted or refused as stated in the Schedule contained in the minute book of this Area Board for this date and the requisite notices issued; the granting of any permission or consent shall not constitute approval, permission or consent by this Area Board or the Council for any purpose other than that mentioned in such Schedule;
(b) notwithstanding the officer’s recommendation, an application for planning permission for the demolition of an existing Mosque buildings and erection of a purpose built Mosque and Madressa at the site of 304 to 306 Barnsley Road and 2 Osgathorpe Road (Case No.07/01306/FUL) be refused, as the Board considered that the proposed building was out of scale and character with nearby properties, created disamenity to local residents and road safety issues by virtue of increased traffic and insufficient onsite car parking and as such was contrary to H14 of the Unitary Development Plan;
(c) an application for planning permission for the erection of six flats in a 1x3 storey block and six dwellinghouses with associated car parking accommodation on land to the rear of 1 to 45 Dykes Hall Road and Clarence Road (Case No.07/02824/FUL) be granted, conditionally, subject to (i) the completion of a Legal Agreement and (ii) additional conditions requiring the applicant to provide details of grey water recycling and rainwater harvesting for approval by the Local Planning Authority;
(d) an application for planning permission for the demolition of a dwellinghouse and erection of 13x1/2 bedroom apartments in a 1x3 storey block to house persons over the age of 55 with associated car parking and landscape works at the site of 14 Sussex Road, Chapeltown (Case No.07/02810/FUL) be granted, conditionally, subject to (i) the completion of a Legal Agreement with an associated financial contribution of £7,323 and (ii) additional conditions requiring (A) details of the boundary wall treatment to be submitted for approval by the Local Planning Authority and (B) requiring the development to be occupied solely by persons of 55 years and over;
(e) an application for planning permission for the erection of 13 dwellinghouses and garages on land opposite 7 to 23 Thrush Street and land between Lark Street and 231 Providence Road (Case No.07/02811/FUL) be granted, conditionally, subject to the completion of the Legal Agreement; and
(f) an application for planning permission for the demolition of existing buildings and erection of seven dwellinghouses on land at the site of 328 Worrall Road (Case No.07/02031/FUL) be granted, conditionally, subject to the completion of a Legal Agreement.
9. MIDHOPESTONES AND ECCLESFIELD CONSERVATION AREA SURVEYS
The Director of Development Services submitted a report on the outcome of consultation on the draft Ecclesfield and Midhopestones Appraisal and Management Proposals and seeking approval for their adoption. The report stated that the City Council was required to have up-to-date appraisals and management plans for all its Conservation Areas under the Best Value Performance Indicator BV219. The purpose of the Conservation Area Appraisal and Management Proposals were outlined with the favourable outcome of the consultation undertaken in the area. Arising from the consultation, the features that residents would like to see preserved or enhanced were indicated in respect of the Ecclesfield Conservation Area Appraisal and boundary changes and the need for improved maintenance of walls and footpaths in respect of the Midhopestones Conservation Area Appraisal.
With regard to suggestions received for extensions to the Ecclesfield Conservation Area Appraisal, it was stated this included several fields and woodlands which were protected by being included in the Green Belt.
A further report on Article 4(2) Directions for the Conservation Areas would be submitted to a future meeting of the Board.
RESOLVED: That the Ecclesfield and Midhopestones Conservation Area Appraisals and Management Proposals be adopted and that boundary changes to extend the Midhopestones Conservation Area, be approved.
10. APPEALS
The Board noted that the First Secretary of State had (a) dismissed an appeal against the decision of the City Council to refuse planning permission for the erection of a dwellinghouse in the curtilage of 63 High Matlock Avenue (Case No 07/00703/FUL); and
(b) received an appeal against the decision of the City Council to refuse planning permission, under delegated powers, and in respect of the associated enforcement action for the retention of a re-built barn at Burnt Hill Farm, Burnt Hill Lane, Oughtibridge (Case No 07/01827/FUL)
