1. APOLOGIES FOR ABSENCE FROM MEMBERS OF THE BOARD
An apology for absence was received from Councillor Alan Whitehouse.
2. DECLARATIONS OF INTEREST
Councillor Sylvia Dunkley declared an interest as a Member of the Sheffield Conservation Advisory Group in relation to those applications that they had considered, but participated in their determination as she had not pre-determined her views on applications during the meeting of the Advisory Group.
3. MINUTES OF LAST MEETING
The minutes of the meeting held on 1st June, 2004, were approved as a correct record.
4. APPLICATIONS UNDER VARIOUS ACTS/REGULATIONS
RESOLVED: That (a) the applications now submitted for permission to develop land under the Town and Country Planning Act 1990 and the Regulations made thereunder and for consent under the Town and Country Planning (Control of Advertisements) Regulations 1989 be decided, granted or refused as stated in the Schedule contained in the minute book of this Area Board for this date and the requisite notices issued; the granting of any permission or consent shall not constitute approval, permission or consent by this Area Board or the Council for any purpose other than that mentioned in such Schedule;
(b) notwithstanding the Officer’s recommendation, an application for planning permission for the retention of decking with under-storage to the front of a dwellinghouse at 17 Waterfield Mews, Westfield (Case No. 04/01128/FUL) be granted for a period of five years from the date of this meeting, with the standard conditions being imposed for this type of development and an additional condition requiring the wooden structure to be stained a dark colour, as the Board considers that the proposed development would not be unduly detrimental to the visual amenities of the area;
(c) an application for planning permission for the erection of a 1 x 2 storey building to be used for general industrial purposes (Use Class B2), the erection of 2 x 2 storey buildings for storage and distribution (Use Class B8) with associated lorry and car parking accommodation at the former Avesta Steel Works Rolling Mill site, Shepcote Lane (Case No. 04/01470/FUL) be granted, subject to (i) a Unilateral Undertaking as detailed in the report now submitted, (ii) Condition 4 being amended to allow the landscaping scheme to be introduced after each phase of the development and to require a further landscaping scheme for the balancing pond to be submitted to the Local Planning Authority for approval and (iii) the Secretary of State for Local Government and the Regions being satisfied that an Environmental Impact Assessment would not be required for the site and thereby the Article 14 Direction, placed by his Office on the application, under the Town and Country Planning (General Development Procedure) Order 1995 being removed or otherwise ceasing to have effect;
(d) an application for a residential development within the curtilage of 244 to 246 Duke Street (Case No. 04/01657/OUT) be granted, subject to the standard drainage conditions being attached; and
(e) in connection with the decision to grant planning permission for the erection of a 1 x 5 storey block of offices with ground floor conference rooms on land off Rockingham Lane (Case No. 04/01289/FUL) Condition 6 be amended with the substitution of the word "offices" for the word "dwellings".
(NOTE: 1. Councillor Sylvia Dunkley declared an interest in an application for planning permission for the erection of 1 x 4 storey building for use as 2 x 4 bedroomed and 2 x 1 bedroomed flats with basement car parking within the curtilage of 9 Norfolk Road (Case No. 04/01538/OUT) and did not speak or vote thereon and left the room prior to consideration of the item.
2. The Board thanked officers for their endeavours in expediting an application for planning permission for the erection of a 1 x 2 storey building to be used for general industrial purposes (Use Class B2), the erection of 2 x 2 storey buildings for storage and distribution (Use Class B8) with associated lorry and car parking accommodation at the former Avesta Steel Works Rolling Mill site, Shepcote Lane (Case No. 04/01470/FUL).)
5. PETITIONS
Outstanding Petitions List
The Board noted (a) a report of the Head of Development Services setting out the position on outstanding petitions that were being investigated and (b) in response to comments from a Member of the Board, in connection with (i) a petition containing 32 signatures requesting road safety measures on Haxby Road and Haxby Street (Item 1 on the list), an acknowledgement by the Head of Development Services of the concerns raised in respect of the period of time taken to investigate the petition and stated that he would review this matter and (ii) a petition containing 36 signatures requesting "Access Only" for residents and visitors on Patmore Road (Item 3 on the list) information reported by the Head of Development Services advising that a report in respect of this petition would be submitted to the Board in August, 2004.
New Petition
The Board noted for investigation by Officers and reporting back to a future meeting, the receipt of a petition containing 94 signatures requesting speed restrictions on Firth Park Crescent.
6. SITE VISITS
RESOLVED: That a site visit be arranged on the afternoon of 9th July, 2004, in connection with any planning applications requiring a visit prior to the next meeting of the Board.
7. OBJECTIONS TO A PROPOSED TRAFFIC REGULATION ORDER: DANGER REDUCTION SCHEME FOR DARNALL ROAD
Further to a decision of the East Area Board at its meeting held on 4th March, 2002, giving approval for the a road safety scheme and authority to advertise a Traffic Regulation Order for Darnall Road near Industry Road, the Head of Development Services submitted a report containing details of the objection received in respect of the Order and detailing a response to the objection. The report (i) referred to a traffic and pedestrian count carried out on 20th September, 2002, a speed survey and the pedestrian accident record in a five year period up to August 2003 and (ii) outlined the proposed measures for the location, the consultations that had been undertaken and the amendments to the original scheme, which had resulted in the proposed waiting restrictions for Basford Street no longer being necessary. It was stated that, whilst further consultation would be carried out with the frontages directly affected by the amended scheme, the loss of parking had been minimised to address the concerns raised and that, in view of the level of support received and the road safety benefits that would be provided, it was considered that the scheme should be progressed.
A location plan, public consultation information and details of the responses received in favour of the scheme were attached as appendices to the report now submitted.
RESOLVED: That (a) the objection in respect of the proposed Traffic Regulation Order for Darnall Road be overruled in the interest of road safety and that authority be given for the Order, as advertised, to be made in accordance with the Road Traffic Regulation Act 1984, as amended; and
(b) the objectors be informed accordingly.
8. VARIOUS PROPOSED TRAFFIC REGULATION ORDERS
RESOLVED: That authority be given for the Head of Development Services to advertise the intention to make Traffic Regulation Orders introducing (a) in the Portobello area of the City;-
(i) a Prohibition of Waiting At Any Time on parts of Mappin Street, Portobello, Regent Street and St. George's Terrace;
(ii) a Prohibition of Loading At Any Time on parts of Mappin Street, Regent Street and St. George's Terrace;
(iii) revisions to the Pay and Display parking bays on parts of Mappin Street, Regent Street and St. George's Terrace;
(iv) a dedicated "disabled" parking bay on part of Mappin Street;
(v) a "loading only" bay on part of Mappin Street;
(vi) a one-way southbound traffic on part of Mappin Street; and
(vii) a Prohibition of Driving of Motor Vehicles except for access on Portobello (Plan No. TR/39/1002 - PAP); and
(b) a Prohibition of Heavy Goods Vehicles (except for access) on various roads in Attercliffe Centre (Plan No. TR/39/127/AC) all as detailed in the report of the Head of Development Services now submitted and shown on the plans now displayed and, subject to no objections being received, for the Orders to be made in accordance with the Road Traffic Regulation Act 1984, as amended.
9. BARKER’S POOL
With reference to a decision of Cabinet at its meeting held on 12th May, 2004, to approve the design of the Barker's Pool and City Hall precincts enhancement scheme, the Head of Development Services submitted a report giving details of the redesigning of the public realm and seeking approval to advertise the intention to make Traffic Regulation Orders to introduce revised parking, traffic systems and servicing arrangements. He stated that the City Centre Masterplan identified the City Hall as one of its seven priority projects. It comprised two mainly public funded elements, namely the restoration of the City Hall as a conference and performance venue and the renewal of the surrounding public spaces, which would give it an appropriate high quality setting. The project would also promote the regeneration of adjacent sites such as the former National Union of Mineworkers’ offices, the Leopold Street former education offices, future proposals for the Fountain Precinct and the new retail quarter. The proposed Traffic Regulation Orders were required to achieve the desired changes to traffic movement and parking in the area.
RESOLVED: That (a) the Cabinet approval for the layout now displayed on Plan No. HD/001345/05 be noted; and
(b) authority be given for the Head of Development Services to advertise the intention to make the necessary Traffic Regulation Orders, as detailed in paragraph 6 of the report now submitted and shown on Plan No. TR/39/142 - CH and, subject to no objections being received, for the Orders to be made in accordance with the Road Traffic Regulation Act 1984, as amended.
10. PROPOSED CLOSURE OF:
Parts of Sheaf Street (A61), a Subway System Under Sheaf Street (A61), Part of Sheaf Square (A61), Part of Leadmill Road (A61), Part of Paternoster Row, Part of Arundel Lane, Part of Arundel Street, Part of Surrey Street and a Public Footpath
The Head of Development Services submitted a report seeking authority to process a Stopping-Up Order for the closure of parts of Sheaf Street, a subway system under Sheaf Street, part of Sheaf Square, part of Leadmill Road, part of Paternoster Row, part of Arundel Lane, part of Arundel Street, part of Surrey Street and a public footpath. The report stated that, whilst the lengths of highway formed part of the existing network serving the City Centre in general and, in particular, the Midland Station, they were no longer required for public use and were considered to be surplus to requirements of the Highway Authority, as a new highway network was to be created as part of the regeneration of the area.
RESOLVED: That (a) no objections be raised to the proposed closure of parts of Sheaf Street, a subway system under Sheaf Street, part of Sheaf Square, part of Leadmill Road, part of Paternoster Row, part of Arundel Lane, part of Arundel Street, part of Surrey Lane and a public footpath, within the City Centre as detailed in the report now submitted and shown on the plan now exhibited, subject to satisfactory arrangements being made with the Statutory Undertakers with regard to their mains and services that may be affected; and
(b) authority be given for the Director of Legal and Administrative Services to take all necessary action on the matter under powers contained within Section 116 of the Highways Act 1980 and to apply to the Magistrates' Court for a Stopping-Up Order for the aforementioned areas of highway.
Part of Pond Street, Part of Harmer Lane and Part of Pond Hill
The Head of Development Services submitted a report seeking authority to process a Stopping-Up Order for the closure of part of Pond Street, part of Harmer Lane and part of Pond Hill. The report stated that, whilst the areas of highway formed part of the highway network surrounding the Transport Interchange, they were no longer required for public use as new access points would be provided as part of the redevelopment of the area. It was considered that the proposed closures would not have a detrimental affect on the adjacent highway network and its users.
RESOLVED: That (a) no objections be raised to the proposed closure of part of Pond Street, part of Harmer Lane and part of Pond Hill, as detailed in the report now submitted and shown on the plan now exhibited, subject to satisfactory arrangements being made with the Statutory Undertakers with regard to their mains and services that may be affected; and
(b) authority be given for the Director of Legal and Administrative Services to take all necessary action on the matter under the powers contained within Section 116 of the Highways Act 1980 and to apply to the Magistrates' Court for a Stopping-Up Order for the aforementioned areas of highway.
11. KENDAL WORKS, CARVER STREET: PROPOSED AMENDMENT TO SCHEME (CASE NOS. 03/02355/FUL AND 03/02357/LBC)
Further to a decision of this Board at its meeting held on 17th November, 2003, in which planning permission was granted for alterations and an extension to a building for use as a café bar with associated offices and a retail unit at the former Kendal Works, 23 to 31 Carver Street (Case Nos. 03/02355/FUL and 03/02357/LBC) subject to clearance by the Secretary of State for Local Government and the Regions, the Head of Development Services reported orally on a proposed minor amendment to the scheme to allow a revised design for the glazed roof element to the courtyard of the building group.
RESOLVED: That, in the circumstances now reported, approval be given to the amended scheme for Kendal Works, 23 to 31 Carver Street (Case Nos. 03/02355/FUL and 03/02357/LBC).
12. APPEALS
To note that the Secretary of State for Local Government and the Regions had received appeals against the decision of the City Council to refuse planning consent for:-
(i) an application to vary Condition 2 imposed by Case No. 02/01805/FUL concerning hours of opening at 575 Attercliffe Road (Case No. 04/00091/FUL); and
(ii) the erection of an 8-storey building comprising A1, A2 and A3 uses on the ground and mezzanine floors with 51 flats above and 31 basement car parking spaces on land adjacent to 125 Fitzwilliam Street (Case No. 03/03280/FUL).
