Byelaws Pursuant to Part VIII of the Local Government (Miscellaneous Provisions) Act 1982

 
 
REPORT OF THE ASSISTANT CHIEF EXECUTIVE, LEGAL AND GOVERNANCE
MEETING OF THE CITY COUNCIL 6TH DECEMBER, 2006
 
 
            At its meeting on 8th November, 2006, the Cabinet considered a joint report of the Executive Director, Development, Environment and Leisure and the Assistant Chief Executive, Legal and Governance concerning the making of byelaws for the proper regulation of businesses involved in tattooing, acupuncture, cosmetic piercing, electrolysis and semi-permanent skin colouring.
           In accordance with the arrangements approved by the Council at its meeting on 5th April, 2000, the report, together with a recommendation of the Cabinet thereon, as set out below, is referred to the City Council for consideration:-
 
BYELAWS PURSUANT TO PART VIII OF THE LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982
            A joint report of the Executive Director, Development, Environment and Leisure and the Assistant Chief Executive, Legal and Governance was submitted seeking to bring fully into force the regulatory framework of Part VIII of the Local Government (Miscellaneous Provisions) Act 1982 (‘the 1982 Act’)(as amended by the Local Government Act 2003) within the Sheffield City Council administrative area, including the provision of the making of byelaws for the proper regulation of businesses involved in tattooing, acupuncture, cosmetic piercing, electrolysis and semi-permanent skin colouring.
RESOLVED: That (a) the City Council hereby (i) adopts sections 14 to 17 of Part VIII of the Local Government (Miscellaneous Provisions) Act 1982 (as amended by the Local Government Act 2003) in their entirety to come into force on 22nd January, 2007 within the administrative area of the City of Sheffield Metropolitan District for the proper regulation of persons carrying out the practices of acupuncture, tattooing, semi-permanent skin-colouring, cosmetic piercing and electrolysis;
            (ii) authorises the making of byelaws regulating the practice of acupuncture under Section 14(7) of the Local Government (Miscellaneous Provisions) Act 1982 as soon as Section 14 of that Act comes into force within the administrative area of the City of Sheffield Metropolitan District;
            (iii) authorises the making of byelaws regulating the practices of tattooing, semi-permanent skin-colouring, cosmetic piercing and electrolysis under Section 15 (7) of the Local Government (Miscellaneous Provisions) Act 1982 as soon as Section 15 of that Act comes into force within the administrative area of the City of Sheffield Metropolitan District; and
            (iv) authorises the Assistant Chief Executive, Legal and Governance, to make the consolidated byelaws attached at Appendix A to the report now submitted and made under the provisions of Sections 14(7) and 15(7) of the Local Government (Miscellaneous Provisions) Act 1982 and to take all necessary steps to secure their confirmation and carry them into effect; and
            (b) the thanks and appreciation of this Cabinet be conveyed to Christina Anderson and Meg Munn, M.P. for their campaigning work on this issue.
(NOTE: 1.  This item is referred for approval by the City Council and cannot, therefore, be called-in for scrutiny; and
2.  Copies of the report are circulated to all Council Members with the Council Summons.)
