Minutes of the Annual Meeting of the Council held on Friday, 18th June, 2004                
 
Annual Meeting of the Council of the City of Sheffield held in the Council Chamber within the Town Hall, Sheffield, on Friday, 18th June, 2004 pursuant to notice duly given and Summonses duly served.

APOLOGIES FOR ABSENCE

2.
ELECTION OF LORD MAYOR
 
 
            Councillor Diane Leek, the retiring Lord Mayor, took the Chair and the Chief Executive announced that the first business to be transacted was the election of a Lord Mayor for the ensuing year.
 
 
            Whereupon it was
 
 
RESOLVED UNANIMOUSLY: On the motion of Councillor Peter Price, seconded by Councillor Arthur Dunworth, that Councillor Mike Pye be and is hereby chosen and elected to Lord Mayor of the City of Sheffield for the ensuing year.
 
 
            Councillor Mike Pye, the Lord Mayor Elect, then made and subscribed  the declaration required by law to qualify him to act as Lord Mayor.
 
 
            Whereupon the retiring Lord Mayor vacated the Chair which was then taken by Councillor Mike Pye, the Lord Mayor.
 
 
 
 
3.
VOTE OF THANKS TO RETIRING LORD MAYOR AND LADY MAYORESS
 
 
RESOLVED UNANIMOUSLY: On the motion of Councillor Paul Scriven, seconded by Councillor Veronica Hardstaff, that the best thanks of the Council under the Common Seal be presented to Councillor Diane Leek and Mr. Robert Leek for the able and very satisfactory manner in which they have performed their various official duties as Lord Mayor and Consort during the past year.
 
 
 
 
4.
APPOINTMENT OF DEPUTY LORD MAYOR
 
 
RESOLVED: On the motion of Councillor Kate Dawson, seconded by Councillor Pat Midgley, that Councillor Roger Davison be and is hereby appointed Deputy Lord Mayor of the City of Sheffield for the ensuing year.
 
 
 
 
5.
APPOINTMENT OF THE COUNCIL LEADER, THE MEMBERS OF THE CABINET, STANDARDS COMMITTEE, SCRUTINY BOARDS, STATUTORY/REGULATORY BOARDS, AREA PANELS AND REPRESENTATIVES ON OTHER BODIES AND TO OTHER POSTS FOR THE YEAR 2004/2005       
 
 
RESOLVED: On the motion of Councillor Pat Midgley, seconded by Councillor Joan Barton that (a) Councillor Jan Wilson be appointed Leader of the City Council and Chair of the Cabinet for the ensuing Municipal Year 2004/2005;
 
 
(b) approval be given to the Portfolios for Cabinet Members in accordance with the details now circulated;
 
(c) the following Bodies, including the Cabinet, the Standards Committee, the Scrutiny Boards, the Statutory/Regulatory Boards and Panels, the Area Panels and the various working groups, monitoring/advisory panels etc., be and are hereby established and appointed for the ensuing Municipal Year, with the memberships as shown on the attached list, together with the representatives on other bodies and to other posts as now indicated; the respective Bodies be entrusted with the same duties, terms of reference and powers (including delegated powers where appropriate) as hitherto, subject to the changes now made at this meeting in respect the revised Cabinet portfolios, and the revised terms of reference and remits of the Scrutiny Boards, which are adopted as now circulated;
 
(d) as respects the membership of the Area Panels, arrangements be made for each Panel to have a minimum of three elected Members serving thereon, and in any circumstances where the changes in the Ward boundaries result in a membership of less than three elected Members for any Panel, the Chief Executive be authorised to nominate additional Members from within the respective Ward(s) to serve on such Panel, up to the minimum level now authorised;
 
(e) attendance at meetings of such Bodies be recognised as an approved duty for the purpose of the payment of Members’ Allowances/expenses;
 
(f) delegated powers be granted to the Cabinet to determine all matters within the list of matters reserved to the Cabinet and matters which would otherwise fall within a “Band A” delegation to Officers where Officers chose specifically to refer the matter for decision to Cabinet, such issues being those which do not fall within the list of matters reserved for Council, or within the remit of the Statutory/Regulatory Boards and Panels as set out in the Constitution of the Council, or within the lists of delegations to Officers, (defined as “Band B” delegations) as set out in the Constitution of the Council;
 
(g) delegated powers, defined as “Band A” delegations, be granted to the Chief Executive and the respective Executive Directors/Heads of Service, to determine all matters which do not fall within the list of matters reserved for Council, the list of matters reserved for Cabinet, or within the remit powers and delegations to the Statutory/Regulatory Boards and Panels, or within the lists of delegations to Officers, (defined as “Band B” delegations) as set out in the Constitution of the Council;
 
(h) meetings of the City Council be held forthwith on a monthly basis, normally at 2.00 p.m. on the first Wednesday of each month, except where indicated, in accordance with the arrangements set out in the Constitution of the Council;
 
(i) meetings of the Cabinet, the Standards Committee, the Scrutiny Boards, the Statutory/Regulatory Boards and Panels and Area Panels etc., be held in accordance with arrangements to be determined by such bodies;
 
(j) confirmation be given to the Council’s Standing Orders, as now circulated;
 
(k) pursuant to the provisions of Standing Order A9(3), the quorum of the Cabinet, the Standards Committee, the Scrutiny Boards and the Statutory/Regulatory Boards and Panels each shall be three voting members, and the quorum for meetings of other bodies etc. shall be two members;
 
(l) for the purposes of Standing Order A33 (2), the consent of the Council be given in any case where a Member chooses not to be appointed to serve on any Scrutiny Board;
 
(m) as respects the appointment of representatives to serve on outside bodies, the Chief Executive, in consultation with the relevant Cabinet Portfolio Member or Opposition Spokesperson(s), as appropriate, be authorised, in cases of urgency, to nominate representatives to serve on such bodies, as necessary, on the understanding that details of such nominations will be reported to the next or subsequent meetings of the Council;
 
            (n) the Chief Executive, in consultation with the relevant Cabinet Portfolio Member and the representatives of the organisation concerned, be authorised agree revised terms of reference for the Allotments and Leisure Gardens Advisory Group, on the understanding that details of such amendments will be reported to the next or subsequent meetings of the Council;
 
            (o) the Executive Directors be requested to review the appointments or nominations of individuals to serve on external organisations in their areas, which are approved at this and subsequent meetings of the Council, and to ensure that such appointments or nominations are in line with the Protocol to assist Members and Officers serving on external organisations, as approved by the former Corporate Strategy Committee on 16th March, 1999; and
 
(p) in the event of this Council being unable at its first meeting to finalise the appointment of representatives to its various bodies, the Chief Executive, in consultation with the relevant Cabinet Portfolio Member or Opposition Spokesperson(s), as appropriate, be authorised to nominate representatives to serve on such bodies, as necessary, on the understanding that details of such nominations will be reported to the next or subsequent meetings of the Council.
