REPORT OF THE DIRECTOR

MEETING OF THE CITY COUNCIL
3RD SEPTEMBER 2003
LICENSING ACT 2003 - COMMITTEE STRUCTURE
At its meeting on 20th August, 2003, the Cabinet considered a report of the Director of Legal and Administrative Services containing details of action required to be taken to amend the current Licensing Board structure of the City Council to take account of the provisions of the Licensing Act 2003 and to provide for appropriate delegations of authority to the new Licensing Committee.
In accordance with the list of matters which are statutorily reserved for Council, as approved at the Council at its meeting on 5th April, 2000, the decision of the Cabinet, as set out below, is referred to the City Council at its meeting on 3rd September, 2003, for consideration:-

"The Director of Legal and Administrative Services submitted a report containing details of action required to be taken to amend the current Licensing Board structure of the City Council to take account of the provisions of the Licensing Act 2003 and to provide for appropriate delegations of authority to the new Licensing Committee. He stated that the main aim of the Act was to modernise and integrate five main licensing systems relating to liquor licensing (currently operated by the Magistrates' Court), public entertainment, cinemas, theatres and late night refreshment (currently operated by the Council) into a single integrated Licensing system administered by the Council. Whilst this report dealt with the setting up of the Licensing Committee, further reports would be submitted to future meetings of the Cabinet dealing with resource implications, procedural matters, draft policy, transitional arrangements and initial variations, etc. |

RESOLVED: That (a) authority be given for the Director of Legal and Administrative Services to take all necessary action to establish a Licensing Committee as soon as is practicable to conduct the functions set out in Section 4 of the report now submitted; |
|
|
(b) the Licensing Committee be named the "Licensing Board" of the City Council; |
|
|
(c) the Director of Legal and Administrative Services be instructed to arrange to report to the newly formed Licensing Board in accordance with Section 5 of the report; and |
|
|
(d) all existing delegations of the present Licensing Board be transferred to the new Licensing Board and, until such time as the report mentioned in paragraph (c) above is placed before the Board dealing with sub-delegation of functions under the new Licensing Act, all existing delegations to the Director of Legal and Administrative Services and to Authorised Officers of the Council under current licensing legislation and detailed in the Council's Constitution are to remain in place." |
