THE CITY OF SHEFFIELD (20 EARL MARSHAL CLOSE) COMPULSORY PURCHASE ORDER 2007
1. Introduction
1.1 On 11th July 2007 Cabinet received a report (Appendix 1) seeking authority to make a Compulsory Purchase Order (CPO) in respect of 20 Earl Marshal Close, Fir Vale, Sheffield (the Property), to allow the Property to be acquired and demolished.
1.2 The plan showing the location of the Property was not displayed and submitted as it should have been, at the time that Cabinet received the report of 11th July 2007. This plan will be relied upon to obtain the CPO and must be properly displayed. The plan is now displayed and submitted and the purpose of this report is to re-present the cabinet report of 11th July 2007 in order to seek authority from Cabinet to make a CPO in respect of the Property.
1.3 The recommendations shown on the front sheet of the original report also showed an incorrectly titled plan. This has been corrected in the present report.

7 Recommendations:
7.1 That the City Council make a Compulsory Purchase Order under the powers conferred by Section 17 Housing Act 1985 in respect of the land coloured pink on the plan entitled “ Map referred to in The City of Sheffield (20 Earl Marshal Close) Compulsory Purchase Order 2007” now displayed and submitted and that:
a) notice of the making of the order be served upon all persons entitled thereto and be published as required;
b) the draft statement of reasons prepared by the Director of Housing be approved and served on all persons entitled thereto;
c) all other necessary steps be taken to enable the Order to be submitted for confirmation by the Secretary of State;
d) the order be submitted to the Secretary of State for confirmation;
7.2 the Assistant Chief Executive, Legal and Governance, be authorised to sign and serve any necessary notices or documents and to take all the other necessary actions to give effect to these recommendations; and
7.3 the proposed arrangements for disposal and the preferential allocation of new housing at Earl Marshal shall be the subject of a further report.
