Land at Allende Way

PROPOSED FREEHOLD DISPOSAL BY PRIVATE TREATY
OF LAND AT ALLENDE WAY SHEFFIELD S9
 
1.0            PURPOSE
 
1.1       To seek approval for the disposal of land at Allende Way Sheffield by way of a private treaty sale, and to grant the Head of Corporate Property Delegated Authority to deal with and finalise the proposed transaction.
 
1.2       To seek approval for the Assistant Chief Executive Legal and Governance to complete the legal documentation for the sale of the land.
 
2.0             BACKGROUND
 
2.1        The City Council owns the freehold title in the area of land shown edged black on the accompanying plan.                        
         
2.2        Brocklebank & Co. (Demolition) Ltd. own the land shown hatched black immediately adjacent to the City Council’s land, and have made a request to purchase the adjoining City Council land in order to consolidate their business.
 
2.3        The use of Brocklebank’s existing land, which includes the storage of construction waste, is contrary to the preferred planning use of the site, however the use is established in the area and a move by the firm is unlikely.
 
2.4        A conditional contract is in place for the disposal of The City Council owned land on the opposite side of Allende Way for residential development.
 
2.5        If Brocklebank’s purchase the City Council’s land, they have agreed to construct a three meter high acoustic screening wall along the Allende way frontage which they would otherwise not be obliged to do.
 
2.6        To ensure financial probity when dealing with Brocklebank & Co. (Demolition) Ltd., Knight Frank were instructed to negotiate to act on the City Council’s behalf in the proposed disposal.
 
2.7        A deal as been agreed at the purchase price shown in appendix A, subject to the purchaser obtaining satisfactory planning consent.
 
3.0        PROPOSALS FOR THE PROPERTY
 
3.1        It is proposed to dispose of the freehold interest in the property to Brocklebank & Co. (Demolition) Ltd. for the price shown in Appendix A.
 
3.2        Subject to obtaining planning consent Brocklebank & Co. (Demolition) Ltd. intend to incorporate the land with their adjoining land into one larger site and construct a three meter high acoustic screening wall along the Allende Way frontage. The proposed disposal will be conditional upon this wall being built.
 
3.3        The land is currently vacant and has been subjected to a degree of illegal dumping and is therefore a maintenance liability.
 
3.4         It is felt that including the land with that of the adjoining site will be more beneficial in terms of the overall regeneration of the area.
 
4.0         CONSULTATION
 
4.1         Consultation has taken place between the Head of Corporate Property and the Head of Development Services.
 
5.0         Marketing
 
5.1        The land has not been placed on the open market as it is felt that there is justification for dealing with the Brocklebank & Co. (Demolition) Ltd. on a private treaty basis because: -
 
  • Given that Brocklebank & Co. (Demolition) Ltd. own the land adjoining that of the City Council, and are looking to include the subject land within their consolidation proposals, they represent a “Special Purchaser”. Consequently, they are more likely to pay a higher price to acquire the City Council’s land holdings.
 
  • The purchaser’s proposals will tidy up their operations in this location with the erection of the wall which will provide a buffer to the proposed housing development site on the opposite side of Allende Way
 
6.0         FINANCIAL IMPLICATIONS
 
6.1        That Cabinet approves the disposal of the premises for the sum referred to in    appendix A of this report.
 
6.2        The capital receipt has been included in the forecast of resources available to support the Council’s capital programme.
 
7.0        EQUAL OPPORTUNITES IMPLICATIONS
 
7.1        There are none known.
 
8.0        HUMAN RIGHTS IMPLICATIONS
 
8.1        There are none known.
 
9.0        ENVIRONMENTAL IMPLICATIONS
 
9.1        There are none known.
 
10.0       PROPERTY IMPLICATIONS
 
10.1       The disposals will result in a reduced management/repair responsibility for the City Council.
 
10.2       The disposal of this land will also mean a reduction in the Council’s portfolio of surplus land.
 
11.0        RECOMMENDATIONS
 
11.1       That Cabinet approves the proposed disposal of the land by way of a conditional contract and on a private treaty basis on the terms reported.
 
11.2       That Cabinet grants the Head of Corporate Property Delegated Authority to deal with and finalise the proposed transaction.
 
11.3       That Cabinet authorises the Assistant Chief Executive Legal and Governance to complete the legal documentation for the sale of the land.
