Introduction to Night-time Uses – Interim Planning Guidelines
Development Services is proposing new Interim Planning Guidance to help the Planning Service deal with applications for development relating to night-time uses. The guidance is aimed at protecting the living conditions of residents by limiting the opportunities for noise and disturbance to directly affect them. Cabinet, in January, approved the draft document for public consultation.
Relevant developments, which may be given time limits for opening, are drinking establishments (Use Class A4), nightclubs (no Class) and hot food take-aways (Use Class A5).
Food establishments such as cafes or restaurants (Use Class A3) will not normally be time limited unless they are considered to have an adverse effect on any nearby residents.
The Guidance deals with the imposition of time limits for opening depending on which part of the City the development arises. In two specific instances there is a need to provide some level of protection for residents from noise and disturbance and these are within the City Centre and defined as Heart of the City and Cathedral Quarter, and Devonshire Quarter, (see Plan 1 in the Guidance). Guideline 1 will apply in these cases, where it is proposed to limit hours to 12.30am closing
People living in the City Centre cannot expect to experience the same levels of quiet as more suburban parts and, apart from the two defined areas, the norm will be not to specify a closing time in any planning approvals unless the living conditions of residents is seen as being affected. Guideline 2, which is an existing planning policy, will apply. This is a criteria approach for each development, assessing the likely impact on the living conditions of residents when applications for nightclub and food and drink uses are considered.
Equally, for the remainder of the City, it is proposed not to have a time limit for closing unless it is considered that adjacent/nearby residents would be directly affected. In these cases, Guideline 2 will apply again apply.
