Section 31(6) Highways Act 1980

Landowners can make a written declaration to the council to state that they recognise all existing public paths on their land but do not want any new public paths to be created. This protects them from paths being claimed across their land (see claimed paths).

The maps showing land under a s31(6) declaration are public documents and can be viewed in our offices. There are currently approximately thirty separate areas of land around the city that are protected from future claims of public paths in this way.
