Fast Track Appeals
In January 2008 the Planning Inspectorate launched a pilot scheme to dramatically shorten the length of time it will take to decide Householder appeals. A ‘Householder’ appeal is one against the refusal of planning permission for development attached to a residential property or within its boundary, using a Householder application form. It does not include a change of use or the erection of a dwelling or householder appeals which are accompanied by an appeal against the refusal of listed building consent or the service of an enforcement notice.
From Monday 11th February 2008 Sheffield City Council will be taking part in the scheme. The pilot is on going and a future note will be posted when the pilot comes to an end.
For the appellant a number of changes have been made. These aim to make the whole process easier to understand, to take part in and ultimately to allow you to receive a decision much more quickly than at present. The appeal form has been simplified to make it shorter and you will no longer need to send the plan with your appeal. You are required to set your full grounds of appeal using the appeal form. The Inspector will look at your appeal afresh, having access to all of the other documents and material submitted at application stage
At the moment it can take up to 20 weeks to receive a decision from the day an appeal is received, the pilot scheme aims to decide any ‘household’ appeal in 12 weeks.
Can I take part?
The Planning Inspectorate is testing these changes in a number of areas, one of which is Sheffield. If you would like to take part in the pilot you need to be submit a Householder appeal and agree to the following:
- Use the ‘written representations’ method of appeal *
- Communicate, wherever possible by email, providing an email address for the planning inspectorate and the council to use.
* This is the method used by 90% of people choosing to appeal Householder applications and means that you are not seeking a Hearing or a Public Inquiry.
