Section 509 of the Education Act 1996 placed a duty on the Local Authority to make “arrangements for the provision of transport and otherwise as they consider necessary or as the Secretary of State may direct” for the purpose of attendance at school. Thus the Local Authority is given both statutory duties and discretionary powers to provide transport. The extent of these is defined in law and case law. (74.5 KB)
